Worker Compensation and Covid-19; Is it Compensable?

Many insureds are concerned about how worker compensation compensability might or might not apply to employees who contract COVID-19.

We are sharing this overview on the topic from IRMI (International Risk Management Institute).

The key points to consider as outlined in the article are:

  • There are 51 worker compensation jurisdictions in the US each with different provisions.
  • Nearly all of the jurisdictions have a provision that requires the illness or injury to arise out of and occur in the course of employment.
  • Other provisions require the injury or illness to be traceable to a specific point in time.
  • Employees in certain industries such as healthcare may have a clearer path to pursuing a worker compensation claim.
