Reopening Guidance for Your Business Including Updated State-by-State Trackers

May 22, 2020

While various states across the country are beginning to allow businesses to reopen, the requirements for doing so differ depending on where your business is located. For example, New York State just issued this Reopening Safety Plan Template. To assist you in determining the specific requirements your business must comply with before reopening, here is an updated State-by-State Reopening Orders Tracker.

In addition, OSHA just issued much awaited guidance on the recording of occupational illnesses, specifically cases of COVID-19. Under OSHA’s recordkeeping requirements, COVID-19 is a recordable illness, and thus employers are responsible for recording cases of COVID-19, if:

  1. The case is a confirmed case of COVID-19, as defined by the Centers for Disease Control and Prevention (CDC);
  2. The case is work-related, as defined by 29 CFR § 1904.5; and
  3. The case involves one or more of the general recording criteria set forth in 29 CFR § 1904.7.
